China’s Patent Commercialization Rate at over 34% in 2020

Over one third of China’s patents reach the commercialisation stage according to the latest official data from the Chinese government.

China’s effective patent commercialisation rate stood at 34.7% in 2020 according to the “2020 China Patent Survey Report” (2020年中国专利调查报告) just released by the China National Intellectual Property Administration (CNIPA).

This included an effective patent commercialisation rate of 44.9% for Chinese enterprises. CNIPA points out that China’s effective patent commercialisation rate stabilised at above 30% during the 13th Five Year Plan (2016 – 2020), while the enterprise patent commercialisation rate has remained consistently above 40%.

CNIPA said that “patent conversion is becoming increasingly active and the effectiveness of patent protections is marked, helping to drive ongoing optimisation of the commercial environment and significantly raise R&D investment.”

The Report indicates that China’s patentee patent infringement ratio was 10.8% in 2020, for a decline of 3.7 percentage points compared to 2015.
